These Terms & Conditions ("Terms") govern access to softwebd.com and related SoftWebd online services. SoftWebd operates primarily from Colombia and also serves clients in the United States. By using the site or creating an account, you agree to these Terms and our Privacy Policy.
1. SoftWebd
SoftWebd provides software development services, WordPress plugins, licensing/account features, and related digital products for businesses, founders, and agencies — principally in Colombia and the United States.

2. Website use
Use the website only for lawful purposes. You must not misuse the site, attempt unauthorized access, interfere with security controls, submit spam or malicious content, or scrape the site in a harmful way.
3. Project inquiries & website pricing
Starting prices and package descriptions on softwebd.com are informational planning ranges. They are not a binding offer or fixed quote. Scope, timeline, currency, taxes (including Colombian IVA where applicable), and fees are confirmed only in a written proposal, statement of work, or contract accepted by both parties.
Submitting the project inquiry form authorizes SoftWebd to contact you about your request and to process the personal data you provide under the Privacy Policy and Colombian Law 1581 of 2012 (and applicable US privacy rules for US residents).
For Colombia-based engagements, invoices and tax treatment follow Colombian rules unless the contract states otherwise. For United States clients, billing currency, tax handling, and contracting entity details will be specified in the proposal.
4. Accounts, plugins & billing
SoftWebd account features (including SoftWebd Pro, licenses, and downloads) are subject to these Terms and any plan terms shown at checkout. You are responsible for safeguarding credentials and for activity under your account.
Payments for SoftWebd products or tips may be processed by Lemon Squeezy or another provider (often acting as merchant of record). Their terms and privacy notices apply to the payment transaction. SoftWebd may suspend accounts that violate these Terms, abuse licensing, or present a security risk.
5. Intellectual property
Website content, SoftWebd branding, and SoftWebd-owned plugins/products belong to SoftWebd or its licensors. Client project deliverables are governed by the applicable project agreement. SoftWebd retains rights to pre-existing tools and reusable components unless otherwise agreed in writing.
6. Free tools & donations
Free SoftWebd plugins/tools are provided as-is. Optional tips do not create employment, partnership, or a support SLA unless SoftWebd agrees in writing.
7. Disclaimers
The website and free tools are provided "as is" and "as available" to the fullest extent permitted by applicable law in Colombia and the United States. SoftWebd does not warrant uninterrupted or error-free operation of the marketing site or free tools.
8. Limitation of liability
To the fullest extent permitted by applicable law, SoftWebd is not liable for indirect, incidental, special, consequential, or punitive damages arising from website use. SoftWebd's total liability related to the website (excluding separately contracted project work) shall not exceed the greater of (a) fees you paid SoftWebd for SoftWebd Pro/subscriptions in the twelve months before the claim, or (b) one hundred US dollars (USD $100) or its equivalent in Colombian pesos (COP) at a commercially reasonable rate.
Liability for paid client projects is defined in the applicable project contract. Nothing in these Terms excludes liability that cannot be excluded under Colombian or applicable US law.
9. Indemnity
You agree to indemnify SoftWebd against claims arising from your misuse of the website, violation of these Terms, or content you submit through forms, to the extent permitted by law.
10. Governing law & disputes
These Terms are governed by the laws of the Republic of Colombia, without regard to conflict of law principles. SoftWebd and you will first attempt to resolve disputes amicably.
Subject to mandatory consumer or other protections that cannot be waived, disputes related to these website Terms shall be submitted to the competent judges and courts of Colombia.
For clients in the United States, a project contract may specify additional or different governing law, venue, or arbitration for that engagement. If a signed project agreement conflicts with this section, the project agreement controls for that project.
11. Language
These Terms are published in English for SoftWebd's international and US audience. SoftWebd may provide a Spanish version for Colombian users. If both exist and there is a conflict for a Colombia-based consumer relationship where Spanish is required, the Spanish version prevails for that relationship unless the parties agree otherwise in writing.
12. Changes
SoftWebd may update these Terms by posting a revised version on this page. Continued use of the website after changes constitutes acceptance, except where additional consent is required by law.
