SoftWebd ("we", "us", or "our") operates primarily from Colombia and also serves clients in the United States. This Privacy Policy (also serving as SoftWebd's personal data processing policy) explains how we collect, use, share, and protect personal information through softwebd.com, SoftWebd accounts, project inquiries, plugins, and related services.
For individuals in Colombia, processing is carried out in accordance with the Colombian Constitution (habeas data), Law 1581 of 2012, Decree 1377 of 2013 (and related regulations), and guidance from the Superintendencia de Industria y Comercio (SIC)("SIC").
By submitting personal data through our forms or creating an account, you grant SoftWebd prior, express, and informed authorization to process your data for the purposes described below, unless another lawful basis applies.

2. Information we collect
2.1 Data you provide
- Project inquiries: name, email, company, website (optional), need/budget/timeline, and project description
- Accounts: name, email, hashed password, and profile data needed to operate the account
- Billing & licenses: subscription and license records (card data is processed by Lemon Squeezy or another payment provider — SoftWebd does not store full card numbers)
- Support or tip/donation communications you send us
2.2 Data collected automatically
- IP address, browser/device information, and security signals
- Usage data if analytics cookies are accepted
- Cloudflare Turnstile anti-bot results on forms
- Cookies and similar technologies (see Cookie Policy)
SoftWebd does not intentionally collect sensitive personal data (datos sensibles) as defined under Colombian law through the marketing site inquiry form. Please do not submit health, biometric, or other sensitive data in project descriptions unless we expressly request it under a separate authorization.
3. Purposes of processing
We process personal data to:
- Respond to and qualify project inquiries (Colombia and US clients)
- Prepare proposals and perform contracts for development / care / retainers
- Create and administer SoftWebd accounts, licenses, and billing
- Provide customer support and communicate about SoftWebd services/products
- Secure the website, prevent spam/fraud, and maintain service integrity
- Improve SoftWebd websites and products (analytics only with cookie consent where required)
- Comply with Colombian and United States legal obligations
4. Authorization (Colombia)
Under Law 1581 of 2012, SoftWebd generally requires your prior, express, and informed authorization before processing personal data. SoftWebd obtains and keeps evidence of that authorization through mechanisms such as:
- The mandatory privacy checkbox on the project inquiry form
- Account registration and acceptance of SoftWebd terms/policies
- Cookie banner choices for optional analytics cookies
You may revoke authorization and/or request deletion when processing does not respect applicable principles and rights, subject to legal retention exceptions (for example accounting, tax, or dispute records).
5. Service providers / processors
SoftWebd may share data with processors that help operate the business, under confidentiality and purpose limitations:
- Cloudflare Turnstile — form spam/bot protection
- Email delivery providers (e.g. Resend) — inquiry and transactional email
- Lemon Squeezy — payments / subscriptions / tips where enabled
- Hosting, database, and CDN providers
- Google sign-in — only if you choose Google authentication where enabled
Some providers process data outside Colombia (including the United States). SoftWebd selects providers with appropriate security practices and processes international transfers in a manner consistent with applicable Colombian rules and SoftWebd's operational needs to serve Colombia and US clients.
SoftWebd does not sell personal data.
6. Cookies

7. Retention
- Inquiries: kept as needed to respond and for ordinary commercial follow-up (typically up to 24 months unless an active relationship or legal need requires longer)
- Accounts/billing: while active and thereafter as required for tax, accounting, and legal compliance in Colombia and/or the US
- Security logs: limited period for abuse prevention
8. Rights of data subjects (Colombia — Habeas Data)
As a data subject (Titular), you may:
- Know, update, and rectify your personal data
- Request proof of the authorization granted to SoftWebd
- Be informed, upon request, about the use of your data
- File complaints with the SIC for alleged violations of Law 1581 of 2012
- Revoke authorization and/or request deletion when legally applicable
- Access your personal data free of charge under the conditions set by law
How to exercise rights (consulta / reclamo)
Send your request to info@softwebd.com or via the contact form, identifying yourself and describing the request (access, update, rectification, deletion, proof of authorization, etc.). SoftWebd may request additional information to verify identity.
- Queries (consultas): SoftWebd will respond within the timelines required by Colombian law (generally up to ten (10) business days, extendable as permitted by regulation).
- Claims (reclamos): SoftWebd will handle claims regarding correction, update, or deletion under the procedure and timelines set by Law 1581 and its regulations (including acknowledgment and resolution periods).
You may also escalate complaints to the Superintendencia de Industria y Comercio (SIC).
9. United States — additional notice
SoftWebd serves customers in the United States. If you are a US resident, SoftWebd processes your information to respond to inquiries, provide services/accounts, and operate the website as described above. Depending on your state (for example California), you may have rights to know, delete, or correct certain personal information and to opt out of "sale" or "sharing" of personal information as those terms are defined under applicable state law. SoftWebd does not sell personal information for money. To submit a US privacy request, email info@softwebd.com.
SoftWebd may disclose information when required by US or Colombian law, or to protect SoftWebd, users, or others from fraud or security threats.
10. Children
SoftWebd services are directed to businesses and professionals. We do not knowingly collect personal data from children under 18. Contact us to delete any such data if discovered.
11. Security
SoftWebd applies reasonable technical and organizational measures (HTTPS, access controls, hashed passwords for accounts, anti-abuse controls). No system is perfectly secure.
12. Changes
SoftWebd may update this policy by posting a revised version with a new "Last updated" date. Material changes may be communicated by email or site notice when appropriate.
